Equality California Thanks Speaker of the Assembly John A. Pérez for Filing a Friend-of-the-court Brief Opposing Proposition 8
Equality California thanks Speaker of the Assembly John A. Pérez for filing a friend-of-the-court brief in the Hollingsworth v. Perry case, commonly known as the Proposition 8 case. The brief, in which the Speaker and 22 nationally recognized legal scholars are represented by attorney Laura W. Brill of the firm Kendall Brill & Klieger LLP, highlights the important role of the courts in overturning ill-conceived laws passed by public ballot, in keeping with the constitutional checks on majoritarian abuses, and the dangers of usurping the deliberative role of representative government.
“As Speaker of the Assembly, John A. Pérez knows the value of deliberation and debate, especially around charged social issues,” said John O’Connor, Equality California executive director. “We thank him for embodying those principles of good government by filing this brief.”
James Madison, in Federalist Paper 10, warns that issues are “too often decided, not according to the rules of justice and the rights of the minor party, but by the superior force of an interested and overbearing majority,” and prescribes the election of representative legislators as the primary method of mitigating the tyranny of the majority. Passing Proposition 8 highlights the damage of momentary discriminatory prejudices being enshrined in a state constitution absent the due consideration of a legislature.
