LGBT Prisoner Safety Act

Bill Number: AB 633

This bill would adopt the National Prisoner Rape Elimination Commission Standards. The bill gives guidance as to how sexual orientation and gender identity and other factors should be considered in order to safely classify and house prisoners.


Why It Matters

"When I was in prison, my life was constantly endangered, and I was constantly harassed by other inmates for being who I am. I was even a victim of sexual assault."

 


 

Status: Reintroduced in January 2010 after a similar bill was vetoed by the Governor in 2008. Passed Assembly Committee on Public Safety on January 12, 2010. Passed Assembly Appropriations Committee on January 21, 2010. Passed Assembly Floor with a 59-9 vote on January 27. Passed Senate Public Safety Committee on June 13, 2010, and Senate Appropriations Committee by a 7-4 vote on August 12, 2010. Passed by the Senate on a 26-9 bipartisan vote on August 25, 2010, and recieved a concurrence vote in the Assembly. Vetoed by the Governor on September 24, 2010.
